AI Oversight: A Critical Examination of Current Policies

Part 2

As I wrote about previously, President Trump’s recent revocation of Biden’s AI Oversight Act stands as a stark reminder of how governance—or the lack thereof—can shape the trajectory of AI development. While deregulation is often celebrated as a catalyst for innovation, it can also lead to unbridled technological growth with consequences we may not fully understand until it’s too late.

Let’s take a closer look at what’s at stake.

Governance: The Paradox of Progress

History has shown us that technological revolutions often outpace the regulations meant to govern them. During the Industrial Revolution, child labor and unsafe working conditions ran rampant until reforms were enacted. Similarly, the digital revolution of the 1990s saw privacy and data protection take a backseat to rapid growth in connectivity.

Now, with AI agents poised to transform nearly every aspect of life, we find ourselves at a similar inflection point. The repeal of Biden’s AI Oversight Act—a policy designed to impose ethical and safety standards on AI development—highlights the tension between innovation and accountability. Proponents argue that oversight stifles progress, while critics warn that deregulation could lead to unintended consequences, from biased algorithms in criminal justice to autonomous weapons operating without human intervention.

Philosophers like Martin Heidegger remind us that technology is not neutral; it shapes how we see and interact with the world. By removing guardrails, are we allowing AI to optimize human experiences—or reduce them to mere data points? The answer, I fear, depends on whose interests are prioritized: those of the few who control AI systems or the broader society that must live with their consequences.

This leads us to question: “Why Are Some Technologies Regulated Quickly While Others Aren’t?”

If you look at how the U.S. and the EU handle regulations, the differences start making sense when you realize they’re built on different approaches to governing new technologies. That’s where some key political science frameworks step in to explain why countries decide to regulate when they do—and why the timing can be so drastically off.

Let’s start with what David Collingridge (1980) called the “Collingridge Dilemma.” The gist is: if you try to regulate technology too early, you don’t really know what its full impact will be, so you risk stifling something that might actually be great. But if you wait until the technology is everywhere—say, when companies have already invested billions—changing the rules gets ridiculously difficult (and expensive). It’s kind of a lose-lose if you don’t plan ahead.

Next, there’s John Kingdon’s (2011) Multiple Streams Framework, which might sound fancy, but really just says that for new regulations to happen, you need three things to line up: people have to recognize there’s a real problem, there has to be a workable solution, and the political climate has to be open to it. In other words, if any of those “streams” are missing—say politicians don’t see any votes to gain from tackling the issue—regulation stalls out until conditions change.

Ulrich Beck’s (1992) concept of the “risk society” comes in handy here, too. He was basically pointing out that modern technologies (like AI or nuclear energy) create these huge, often invisible risks that we don’t fully grasp until something goes wrong. Think about data privacy or algorithmic bias. We don’t see the threat right away, so the public might not freak out until a big scandal hits. By then, the tech has usually rooted itself into daily life and corporate interests, making it even harder to regulate.

Well, in the U.S., there’s usually a big emphasis on innovation, free markets, and letting things evolve naturally. That means they might wait until the evidence of harm piles up before stepping in. Meanwhile, the EU tends to lean more on the “precautionary principle,” putting safeguards in place earlier, even if the downsides aren’t 100% proven yet. The General Data Protection Regulation (GDPR) is a classic example of the EU saying, “We see potential for abuse, so let’s keep things in check now.”

In simpler terms, it’s all about balance. If a technology seems obviously risky, the public’s raging about it, and industry can’t mount a strong defense, you’ll probably get quick rules. If the risks aren’t in everyone’s face yet, the public is mostly chill, or corporate interests are sky-high, expect a slow road to regulation—no matter which side of the Atlantic you’re on.

By understanding these frameworks and using the Regulatory Speed Score, we can better anticipate how and when new technologies like AI might be regulated. It’s a reminder that proactive, thoughtful governance is crucial to harnessing AI’s benefits while mitigating its risks. The key takeaway? The Problems and Risks of Mismanagement

So, what exactly is AI bias? At its core, AI bias happens when artificial intelligence systems make decisions that unfairly favor or disadvantage certain groups of people. This can stem from biased data, flawed algorithms, or even the way society’s prejudices sneak into technology. Researchers like Buolamwini and Gebru (2018) have shown that facial recognition systems can perform poorly for women and people of color because the data they were trained on wasn’t diverse enough. Similarly, Hardt, Price, and Srebro (2016) are working on ways to make these algorithms fairer by tweaking how they process information.

2. Privacy Erosion

With AI agents constantly learning from vast amounts of data, privacy becomes a major concern. Think about how much personal information we share online every day—from social media posts to shopping habits. AI systems can analyze this data to predict our behavior, sometimes without our explicit consent. The result? These problems aren’t just technical issues—they’re deeply ethical and philosophical dilemmas that require thoughtful debate and careful consideration. On one hand, AI can bring about incredible advancements and improvements in quality of life. On the other hand, without proper oversight, it can exacerbate existing problems and create new ones that we’re not prepared to handle.

In my opinion, it all comes down to the key debate around how to balance innovation with responsibility. Advocates for rapid AI development argue that delaying progress could mean missing out on significant benefits, such as breakthroughs in healthcare, climate change mitigation, and economic growth. Critics, however, warn that unchecked AI development could lead to scenarios where the technology harms society in ways that are difficult to reverse.

As we navigate the ever-evolving landscape of artificial intelligence, the urgency for responsible governance has never been clearer. Our journey so far has highlighted the immense potential of AI agents and the profound philosophical questions they raise about human purpose and technological progress.
